James Arthur settles copyright lawsuit with The Script over his biggest hit.
Former X - Factor winner James Arthur has settle a copyright infringement case with Irish pop rock band the Script. Over allegation Arthur used their material in his biggest hit of his career so far " SAY YOU WON'T LET GO".
James Arthur was issued with legal papers by the Script legal team, claiming
James had used some of the Script music, without their consent that
Arthur song was very similar to that of the Script 2008 single
" The Man That Can't Be Moved "
The exact details of the settlement have not been made public as this agreement
may hold a confidentiality clause.
What we do know so far is that the Script Singer Daniel O' Donoghue
and the guitarist Mark Sheehan have now been formally credited and listed
as songwriters on Arthur single.
Sources to both singer James Arthur and The Script have agreed to not to discuss the settlement as part of the deal which has been agreed.
The Scripts legal representative Richard Busch who successfully won another high profile copyright case against Robin Thicke on behalf of Marvin Gaye Estate
had simply stated that Arthur had used section of the script music without
the consent of the band or giving the band credit and royalists to the single.
Richard Busch also estimated that Arthur had generated around
£14 Million pound from the song.
The copyright lawsuit demanded statuary damages
for "all streaming, distribution, publishing and touring revenue
connected to the single.
The Script legal representative also argued that Arthur had previously
had minimal success and was also dropped by Syco Music after
Arthur had made several homophobic tweets.
Richard Busch also went on to say " That it wasn't until Arthur release the single
'SAY YOU WONT LET GO' did the signer achieve worldwide success.
